The Minnesota Supreme Court heard oral argument in a case concerning the 14th Amendment’s insurrection clause and former President Donald Trump’s eligibility for the state’s 2024 presidential ballot. The Free Speech For People nonprofit filed the suit arguing the former president is ineligible because of his attempt to overturn the 2020 presidential election results and his encouragement of the January 6, 2021, attack on the U.S. Capitol. Under the insurrection clause any public official who has “engaged in insurrection or rebellion” or given “aid or comfort” to insurrectionists is disqualified from holding that office again. This case is one of several filed by this group in other states. close
